Welcome to Khartos. By creating an account or using any feature of Khartos, you fully agree to these Terms of Service. Please read them carefully before proceeding.

1. Acceptance of Terms

By accessing or using Khartos, you represent that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any provision, do not use the service. Khartos may refuse or suspend access for any user who violates these terms.

2. Description of Service

Khartos is a travel planning platform that uses Artificial Intelligence to generate destination guides, itineraries, pre-trip checklists, and logistics insights. The service is provided solely for personal, non-commercial use. Khartos is not a travel agency, does not sell tickets, accommodations, or insurance, and is not responsible for the performance of any third-party services mentioned in generated content.

3. User Accounts

To use Khartos, you must create an account with truthful and up-to-date information. You are solely responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately if you become aware of any unauthorized use. The minimum age to use Khartos is 18 (eighteen) years, in compliance with the Brazilian General Data Protection Law (LGPD) and the policies of our Artificial Intelligence providers.

4. AI-Generated Content

Destination guides, itineraries, checklists, and other content generated by Khartos are produced by Artificial Intelligence models based on the information you provide about your trip. This content is purely suggestive and informational. Khartos does not guarantee the accuracy, timeliness, or completeness of generated information. You must always verify critical data — such as visa requirements, health advisories, local regulations, and transport conditions — through official sources before making any decisions. AI content generation requires your explicit consent, which may be revoked at any time by contacting support at support@khartos.com.

5. Marcos (MK), Payments, and Refunds

Khartos uses a virtual currency called Marcos (MK) to access premium features on the platform. Marcos have no intrinsic monetary value, are not convertible to cash, and are not transferable between accounts. Marcos acquired through one-time purchases do not expire. Marcos granted monthly through the Premium plan are renewed each billing period and do not accumulate between periods — unused monthly balance expires at the end of the cycle. Purchases of Marcos and subscriptions are processed by Mercado Pago, which acts as the payment processor; Khartos does not store credit card data, nor does it collect your CPF (Brazilian national tax ID). In accordance with Article 49 of the Brazilian Consumer Protection Code, you may request a full refund of a one-time purchase or the first subscription charge within 7 (seven) calendar days from the transaction date. Marcos already consumed on the platform before the refund request will not be deducted from the financial refund, but they will lose their validity and be reversed from the available balance down to a floor of zero. Subscription cancellation terminates Premium access at the end of the current period, with no proportional refund for remaining time. This cancellation differs from the right of withdrawal under Article 49: when you request a refund of the first charge within the 7 (seven) day period, Premium access is revoked immediately upon refund confirmation, not at the end of the current period. Khartos reserves the right to change package and plan prices, discontinue offers, or modify the quantity of Marcos granted, with 30 (thirty) days prior notice. Price changes do not affect completed transactions.

6. Privacy

Your use of Khartos is also governed by our Privacy Policy, which details what personal data we collect, how we use it, and how you can exercise your rights. By accepting these Terms, you acknowledge that you have read and agreed to the Privacy Policy.

7. Limitation of Liability

Khartos is provided on an 'as is' basis, without warranties of any kind, express or implied. Khartos shall not be liable for direct, indirect, incidental, or consequential damages arising from the use of AI-generated content, including, without limitation, financial losses, travel delays, or decisions based on inaccurate information. The total liability of Khartos, where applicable, shall be limited to the amount actually paid by the user in the 12 (twelve) months preceding the event giving rise to the claim.

8. Termination

You may close your account at any time through My Account settings or by contacting our support team at support@khartos.com. Khartos may suspend or terminate your account without prior notice if you violate these Terms of Service, use the service fraudulently, or impair the platform's operation. Upon termination, your right to use the service ceases immediately; personal data will be handled in accordance with the Privacy Policy and applicable law.

9. Changes to Terms

Khartos may modify these Terms of Service at any time. Changes take effect upon publication of the updated version on the platform, with the new update date indicated. Continued use of the service after publication constitutes acceptance of the modified terms. For material changes, Khartos will make reasonable efforts to notify users in advance.

10. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Federative Republic of Brazil. For the resolution of any dispute arising from these Terms, the parties elect the jurisdiction of the user's domicile, in accordance with Article 101, I, of the Brazilian Consumer Protection Code.
